Alcune riflessioni su The Force of Law di Schauer

In this article, I will analyze some arguments developed by Schauer in this book The Force of Law, in particular the role of the coercion in law. Coercion is not only a typical feature of law, but is an empirical-universal feature, present in all systems of positive law which exist, will ever exist and historically existed.

Rule of Recognition, Convention and Obligation. What Shapiro Can Still Learn From Hart’s Mistakes

Shapiro works out a version of legal positivism, taking as its starting point Hart’s practice theory of law. Some serious limits of Hart’s practice theory of norms concern the conception of legal obligation and normativity of law. In this chapter, I analyze the limits of Hart’s conception of legal normativity and I appraise whether the planning theory of law indicates the correct direction for overcoming them. An immense task: Hart sull'obbligo di obbedire al diritto

The topic of legal normativity absorbed Hart until the last years of his life. This paper offers a diachronic analysis of Hart’s perspective on the obligation to obey the law. The aim is to show that, at least as regards the justification of the obligation to obey the law, Hart’s former attempt to maintain the autonomy of law from morality and coercion is not convincing and that the “conventionalist turn” sketched in the Postscript leads to a dead end. Therefore, to give up the autonomy of legal obligation from moral obligation seems the only way forward, being aware that this move does not imply the abjuration of legal positivism.

The author critically discusses some main points of Tommaso Greco’s book La legge della fiducia. Greco distinguishes two models of law – the fiduciary model and the anti-fiduciary one – and supports the first model with good arguments. This review, while endorsing Greco’s conclusions, emphasizes some reason for perplexity and claims that the anti-fiduciary model of law helps to maintain a critical attitude towards the law.

Con la sentenza n. 2315/2020 la Suprema Corte ha affermato il principio che l’accertamento dell’anzianità di servizio conseguente ad un trasferimento d’azienda può essere affrontato nell’ambito del rito speciale di impugnazione del licenziamento introdotto dalla L. n. 92/2012. Nella decisione in commento la Corte ha altresì modo di dare continuità all’orientamento per cui la fattispecie traslativa si perfeziona anche in presenza di un mero passaggio di personale in forza di obbligo contrattuale o di legge. With judgement n. 2315/2020 the Supreme Court affirmed the principle that the ascertaining of seniority of service of the employee because of a transfer of undertaking can be examined by the judge according to the special rules of law n. 92/2012. The Court does not exclude a transfer of undertaking also in the case it concerns the staff only for a contractual or legal obligation. If the new employer aquires staff and organized goods there is a transfer of undertaking regulated by art. 2112 of the civil code in the light of the European law.Settore IUS/07 - Diritto Del Lavoro
